FACILITY REGULATIONS
§ 1 Subject of the Regulations
1. The Regulations apply to all persons staying on the premises of the Arka Medical SPA Facility in Kołobrzeg at Sułkowskiego 11, hereinafter referred to as the "Facility".
2. The Regulations define the rules for providing services, the scope of responsibility of Guests and the Facility, as well as the rules for staying on the Facility's premises.
3. The Regulations constitute an integral part of the contract concluded by making a reservation, paying a deposit or the full amount for the stay at the Facility.
4. By performing the above-mentioned actions, the Guest confirms that they have read and accepted the terms of the Regulations.
§ 2 Hotel Day
1. Rooms are rented by the day. The hotel day lasts from 3:00 PM to 11:00 AM the following day.
2. If the Guest does not specify the length of stay when renting the room, it is assumed that the room is rented for one day.
3. Requests to extend the stay beyond the period indicated on the arrival day should be reported to the reception by 9:00 AM on the day the rental period expires.
4. The Facility will consider the request to extend the stay subject to availability and the current price.
5. The room cannot be transferred or made available to third parties, even if the paid period has not yet expired.
6. Unregistered persons may stay in the room from 7:00 AM to 10:00 PM. After 10:00 PM, the Guest is obliged to register additional persons staying with them in the room.
7. Failure to vacate the room by 11:00 AM will be treated by the Facility as an extension of the hotel day until 5:00 PM, for which a fee of PLN 150.00 per person over 11 years old will be charged.
§ 3 Services Provided by the Facility
1. The Facility provides free services in the following areas:
a) providing information related to stay and travel,
b) wake-up service,
c) safekeeping of money and valuables in a deposit box during the Guest's stay at the Facility and luggage storage for Guests registered at the Facility.
§ 4 Return of Left Items
1. Personal items left by a departing Guest in the hotel room may be sent to the address indicated by the Guest only upon their express request, at the Guest's expense.
2. In the absence of such instructions, the hotel stores the items for three months.
3. After this period without collection, the hotel disposes of the items in accordance with applicable law.
4. Items without utility value or posing a sanitary hazard may be disposed of.
§ 5 Reservation and Registration at the Facility
1. The basis for registering a Guest at the Facility is a personally signed registration card and presenting a photo ID to the Reception staff. Refusal to perform these actions results in refusal to conclude the contract.
2. By using in any way the services provided by the Facility, the Guest accepts:
a) these regulations,
b) reservation procedure,
c) privacy policy,
d) personal data protection policy,
e) child protection policy.
2a-e Persons arriving with a pet also accept the pet stay regulations.
3. The reservation becomes guaranteed after a deposit payment specified in the reservation confirmation, within the deadline indicated in the confirmation.
4. On the day of arrival, the Reception collects payment for the entire stay.
5. In case of the Guest's resignation during the hotel day, the Facility does not refund the remaining stay fees.
6. The Facility may refuse to accept a Guest if they grossly violated the regulations during a previous stay at the Facility.
7. In case of gross violation of the Regulations by the Guest, the Facility may:
a) refuse to continue providing services to them,
b) refuse services upon their next arrival.
8. The Facility may refuse services to a Guest under the influence of alcohol, psychoactive substances, or showing verbal or physical aggression.
9. On the day of departure, all Guests are obliged to return hotel wristbands and cards entitling them to rent pool towels at the hotel reception. Failure to return the hotel key (wristband, card) will result in a charge according to the current price list.
§ 6 Stay of Animals
1. Due to the limited number of rooms designated for stays with animals, the Facility accepts domestic animals in rooms with Guests only upon prior notification during the reservation.
2. The Facility accepts only domestic animals (dogs and cats) weighing up to 30 kg. The Facility does not allow stays with dogs considered aggressive, in accordance with the Regulation of the Minister of Internal Affairs and Administration dated April 28, 2003.
3. The animal stay is payable on the day of arrival according to the currently effective price list.
4. In the case of an unregistered animal at the reception, the hotel has the right to:
a) charge a daily fee for the animal's stay from the day of detection,
b) charge a one-time fee of PLN 500 to cover additional cleaning, ozonation, and disinfection of rooms not intended for animal stays.
5. Details regarding stays with animals are specified in the Pet Stay Regulations, available on the website www.arka-mega.pl.
§ 7 Facility's Liability
1. The Facility is insured as stipulated by applicable provisions of the Civil Code. The Guest is obliged to notify the Facility's reception immediately after the occurrence of damage.
2. The Facility is not responsible for the loss or damage of valuables not deposited.
3. The Facility is also not responsible if the Guest improperly secured the room – did not lock doors, windows, or balcony doors.
4. The Facility is responsible for loss or damage to items brought by persons using its services within the scope defined by the Civil Code.
5. The Facility reserves the right to refuse to accept for deposit:
a) large amounts of money or items of significant value,
b) items that pose a safety risk or bulky items that cannot be placed in the deposit. Valuable things are accepted subject to free space availability.
6. The Facility is not responsible for damage or loss of cars or other vehicles parked by Guests in unguarded parking managed by the Facility, nor for items left in these vehicles.
7. Details regarding car parking are available on the Facility's website, at the reception, and at the parking entrance.
§ 8 Guests’ Liability
1. Children under 14 years old should stay on the Facility premises under constant supervision of legal guardians. Legal guardians are financially responsible for damages caused by their wards.
2. Any damages occurring on the Facility premises should be immediately reported to the Reception.
3. The Guest is fully financially responsible for any damage or destruction of the Facility's equipment and technical devices, hotel room or common areas caused by themselves, minors under their care, or their visitors.
4. For damages caused by the Guest or persons indicated in point 3, the Facility has the right to charge the Guest's credit card or issue a billing note even after their departure. The same applies to triggering fire alarms due to vandalism or ignoring the smoking ban. The material value of the damage is determined by the Facility's Reception based on the current price list.
5. Smoking of tobacco products and electronic cigarettes is completely prohibited throughout the Facility. Smoking in the room will result in a PLN 1000 charge added to the bill of the registered person for cleaning, airing, and additional laundry of the room and equipment.
6. Leaving the room by the Guest in a condition requiring excessive cleaning, equipment cleaning, laundry, or other damages resulting in the room being unavailable, will result in a PLN 500 fee per day of room unavailability added to the registered person's bill.
7. Bringing and consuming alcohol purchased outside the Facility is completely prohibited in gastronomy points and public areas within the Facility. Violation results in a fee corresponding to the value of the possessed alcohol according to the price list effective at the date of the incident. Refusal to pay the fee will result in the Guest being asked to leave the gastronomy point or Facility immediately (applies to external Guests).
§ 9 Room
1. Night quiet hours apply from 11:00 PM to 7:00 AM in rooms. The hotel may refuse to continue providing services to persons violating this rule.
2. It is forbidden to store hazardous materials in the room, including weapons, ammunition, flammable materials, explosives, irritants, and other items or substances posing a threat to Guests or Facility staff.
3. For fire safety, the use of electrical devices not included in the room equipment is prohibited, except for chargers and power adapters for electronic devices.
4. Changes to the room furnishings may only be made by hotel staff.
5. Taking furnishings outside the Facility premises is prohibited.
§ 10 Restaurant
1. Entry to the restaurant is possible upon presenting the hotel key (wristband or card).
2. During meals, use of buffets in the restaurant is mandatory and taking meals outside the restaurant is prohibited.
3. In restaurants and other gastronomy points, including adjacent public areas, the following are prohibited:
a) being dressed in bathrobes, swimwear, etc.
b) consuming alcohol and drinks purchased outside the consumption area.
2. Bringing pets into restaurants, gastronomy points, and medical areas is prohibited.
§ 11 Complaints
1. Guests have the right to file complaints if they notice deficiencies in the quality of services provided.
2. Complaints should be filed immediately after noticing a deficiency.
3. Complaints about the stay at the Facility will be considered only if properly submitted in writing via one of the following methods:
a) in person at the Facility's Reception with a written confirmation from the Reception staff;
b) electronically at: reklamacje@arka-mega.pl
c) by traditional mail to: Arka Medical Spa, ul. Sułkowskiego 11, 78-100 Kołobrzeg;
4. Complaints without a return address will not be considered.
5. Properly submitted complaints with a return address will be processed within 14 days from receipt.
§ 12 Information on Processing of Facility Guests' Personal Data
1. The Data Controller is Serwis Arka Medical SPA Sp. z o.o. headquartered at ul. Złota 61 lok. 100, 00-819 Warsaw.
2. The Facility requires the Guest to provide data necessary for providing and settling hotel services such as: - first and last name, - PESEL or series and number of identity document, - address of residence, - vehicle registration number.
3. The legal basis for processing the personal data indicated in point 2 § 11 is art. 6 section 1 point b and art. 6 section 1 point f GDPR.
4. In case of lack of consent to process the personal data necessary for the provision and settlement of hotel services, the Hotel will refuse to conclude a contract for the provision of the indicated services.
